New Powers for Regulators
04.02.10
From 3rd February 2010, breaking environmental regulations will be much more risky for UK businesses as UK regulators will be given new powers to enforce the environmental law.
The Environment Agency and Natural England will become the first regulators to be given the new powers, which are aimed at giving them greater flexibility in law enforcement, and as such they will be able to issue fines, on-the-spot-penalties and compliance notices, instead of costly and time consuming criminal prosecutions.
Under the Regulatory Enforcement and Sanctions Act 2008 these regulators will have to power to use sanctions as an alternative to criminal prosecutions, particularly where the majority of non compliance is unintentional.
Therefore it's even more vital for businesses and organisations to adhere to the various waste regulations that apply to them. PHS Wastemanagement are on hand to offer advice and guidance for compliance, as well as providing a variety of services designed to find the most legislatively compliant, cost effective and environmentally responsible waste management solutions.
These sanctions will not replace criminal prosecution, which may still be used where it’s deemed appropriate.
